Welcome to ClosingRace. These Terms and Conditions govern your use of our platform. By using ClosingRace, you agree to these terms.

1. Scope

These terms apply to all users of ClosingRace, including workspace administrators, team leaders and members. They govern the relationship between Balane GmbH ('we', 'us', 'our') and you as a user.

2. Service Description

ClosingRace is a B2B platform for team challenges and gamification. Our service includes:

• Creation and management of workspaces
• Team challenges and competitions
• Progress tracking and leaderboards
• Analytics and reporting features

3. Registration and Account

You must be at least 18 years old and legally capable to use ClosingRace. Business accounts require authorization by your organization.

You are responsible for maintaining accurate account information and keeping your access credentials confidential.

4. Subscription and Payment

ClosingRace is offered as a subscription service with various plans.

Pricing

Current prices are displayed on our pricing page. We reserve the right to change prices with 30 days' notice.

Billing

Subscriptions are billed monthly or annually in advance. Payment is processed via Stripe.

Free Trial

We offer a 14-day free trial. No payment method is required during the trial. After the trial, you must subscribe to continue using the service.

5. User Obligations

By using ClosingRace, you agree to:

• Use the service only for lawful purposes
• Not to attempt unauthorized access to the system
• Not to share your access credentials with others
• Respect other users and maintain professional conduct
• Comply with your organization's policies when using ClosingRace

6. Workspace Management

Workspace administrators are responsible for managing their workspace members and ensuring compliance with these terms within their organization.

Administrators can invite or remove members, manage settings, and control access to workspace features.

7. Challenges and Competitions

Challenges created on ClosingRace are intended solely for motivation and team-building purposes.

ClosingRace is not a gambling platform. Any stakes or rewards are defined by workspace administrators and remain their responsibility.

8. Intellectual Property

All rights to the ClosingRace platform, including software, design, and content, belong to Balane GmbH.

You retain the rights to content you create. By posting content you grant us a license to display it within the platform.

9. Liability

Our liability is limited to intent and gross negligence. In cases of ordinary negligence, we are only liable for the breach of essential contractual obligations.

We are not liable for indirect damages, lost profits, or data loss, except in cases of intent or gross negligence.

10. Termination

You can cancel your subscription at any time through your account settings. The cancellation will take effect at the end of the current billing period.

We may terminate your account with immediate effect in the event of a breach of these terms.

Upon termination, your access to the service ends. Your data will be deleted in accordance with our privacy policy.

11. Data Protection

The processing of personal data is governed by our privacy policy, available at Privacy Policy.

12. Changes to the Terms

We may change these terms with 30 days' notice. Continued use after the changes take effect will be considered acceptance of the new terms.

13. Applicable Law

These terms are governed by German law. The place of jurisdiction for business customers is Munich, Germany.

14. Severability clause

If any provision of these terms is invalid, the remaining provisions shall remain unaffected.

15. Language clause

These General Terms and Conditions are written in German. Translations into other languages are provided for information only. In the event of any conflict or discrepancy between the German version and a translation, only the German version shall prevail and be legally binding.
